These terms cover your use of Tower Climber, published by DataXad. By playing the game you accept them. If you do not accept them, please do not play.
Using the game
You may install and play the game on devices you own or control, for your own personal, non-commercial entertainment. You may not sell, rent or redistribute the game, and you may not reverse-engineer, decompile or modify it, except where the law expressly says you may regardless of this clause.
Your progress
Scores, unlocks and settings are saved only on your device. They can be lost by uninstalling the game, by clearing its storage, by using the reset buttons on the About screen, or through a device failure. There is no backup and no way to recover lost progress.
No warranty
The game is provided "as is", without warranty of any kind. It may contain faults, it may not run correctly on every device, and it may be updated or withdrawn at any time. Nothing here limits rights that consumer law in your country gives you and does not allow to be waived.
Limitation of liability
To the fullest extent the law allows, the developer is not liable for any indirect or consequential loss arising from your use of the game, including lost progress. Nothing in these terms excludes liability that cannot lawfully be excluded.
Health and safety
Play in a well-lit room, sit a comfortable distance from the screen, and take a break every so often. A very small number of people may experience seizures when exposed to flashing lights or patterns, including in video games. If you or anyone in your family has a history of seizures or epilepsy, consult a doctor before playing. Stop playing immediately and seek medical advice if you experience dizziness, altered vision, eye or muscle twitching, disorientation, involuntary movement or convulsions.
Advertising and purchases
The game shows no advertising and sells nothing. There is nothing to buy, no subscription, and no in-game currency you can pay for.
Ownership and third-party components
Tower Climber is an independent game. The game, its artwork and its code belong to its developer, apart from the third-party components described below. You are given permission to play it, not ownership of it.
The game uses open-source software, sound effects and a font supplied by other people, each under its own licence. Those licences are listed in full in the game under About, then Licences and credits, and they govern those components rather than these terms.
If part of these terms does not hold
If any part of these terms turns out to be unenforceable where you live, the rest of them still applies.
Changes to these terms
These terms may be updated as the game changes. The date at the top shows when they were last revised, and continuing to play after a change means you accept the revised terms. Because the game runs on your device, the terms only ever change when you install an update.
